End-User License Agreement (EULA) of MyITest4U
This End-User License Agreement ("EULA") is a legal agreement between you and the developers of MyITest4U.
This EULA agreement governs your acquisition and use of MyITest4U ("Software") directly from the website MyITest4U.com or indirectly through an authorized reseller or distributor (a "Reseller").
Please read this EULA agreement carefully before completing the installation process and using the Software. It provides a license to use the Software and contains warranty information and liability disclaimers.

It is your responsibility to take care that no harm from the Software comes to you, other persons, your devices, your company and so on.
If you register for a free trial of the Software, this EULA agreement will also govern that trial. By clicking "I Agree" or installing and/or using the Software, you are confirming your acceptance of the Software and agreeing to become bound by the terms of this EULA agreement.
If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Software, and you must not accept this EULA agreement.
This EULA agreement shall apply only to the Software supplied by the developers of MyITest4U herewith regardless of whether other software is referred to or described herein. The terms also apply to any MyITest4U updates, supplements, Internet-based services, and support services for the Software, unless other terms accompany those items on delivery. If so, those terms apply.
If you do not agree to all of the terms of this EULA, then you should not download, install and use the Software. If you have already downloaded or installed the Software, you should remove the Software from your system and destroy all copies.
WebDriverManager
MyITest4U allows to use WebDriverManager to manage the web drivers for the different web browsers (see "https://bonigarcia.dev/webdrivermanager/"). WebDriverManager will collect some information about your installed web browsers and will download and store the appropriate web drivers on your system. MyITest4U has no control over WebDriverManager, about the data collected and about the data which will be transferred between your system and the Web. The transferred data might contain personal information. If you do not agree to this, please do not use WebDriverManager and you have to do the driver management manually.
License Grant
Evaluation License
A time limited version of the Software, Evaluation License, is provided for a period of thirty (30) days ("Evaluation Period") from the date of issuing a temporary evaluation License Key. The time limited version is subject to all terms set forth in this EULA with the exception that the Evaluation License is not for general commercial use.
The Software contains a feature that will automatically disable the use of the Software after the Evaluation Period has expired. You may not disable, destroy, or remove this feature of the Software, and any attempt to do so will be in violation of this EULA and immediately terminate this agreement.
Single user license
The developers of MyITest4U hereby grants to you, an individual purchasing a single-user, non-exclusive, royalty-free license, the right to install and activate the Software on one computer for personal and commercial use. Sharing this Software with other individuals is in violation of this license. Licensed Software is licensed, not sold.
Restrictions.
You may not rent or lease the Software or its activation key to any other party. You may not alter, merge, modify, adapt, reverse engineer, decompile or disassemble the software, unless express authorization to do so is given to you by the developers of MyITest4U.
You may not reproduce, copy, distribute, resell or otherwise use the Software for any commercial purpose.
You may not allow any third party to use the Software on behalf of or for the benefit of any third party.
You may not use the Software in any way which breaches any applicable local, national or international law.
You may not use the Software for any purpose that the developers of MyITest4U consider is a breach of this EULA agreement
Intellectual Property and Ownership
Ownership
The Software is the property of the developers of MyITest4U. The Software is licensed, not sold. Title and copyrights to the Software, in whole and in part and all copies thereof, and all modifications, enhancements, derivatives and other alterations of the Software regardless of who made any modifications, if any, are, and will remain, the sole and exclusive property of the developers of MyITest4U.
Termination
This EULA agreement is effective from the date you first use the Software and shall continue until terminated. You may terminate it at any time upon written notice to the developers of MyITest4U.
DISCLAIMER OF WARRANTY
IN NO EVENT SHALL THE DEVELOPERS OF MyITest4U BE LIABLE TO ANY PARTY FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF THE SOFTWARE, ITS DOCUMENTATION, OR ANY DERIVATIVES THEREOF, EVEN IF THE DEVELOPERS OF MyITest4U HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
THE DEVELOPERS OF MyITest4U SPECIFICALLY DISCLAIM ANY WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THIS SOFTWARE AND ITS DOCUMENTATION ARE PROVIDED ON AN "AS IS" BASIS, AND THE DEVELOPERS OF MyITest4U HAVE NO OBLIGATION TO PROVIDE MAINTENANCE, SUPPORT, UPDATES, ENHANCEMENTS, OR MODIFICATIONS.
Disclaimer of liability
The developers of MyITest4U exclude any liability for simple negligence and for auxiliary persons. The developers of MyITest4U shall in no event be liable for any lost profits, revenues, or business opportunities, loss of use, loss of data, loss of confidential or other information, business interruption and any other direct, indirect, special, incidental, criminal, subsequent or consequential damages whatsoever, whether based on contract, tort, negligence, product liability or otherwise, arising out of or in any way related to the use of or inability to use the Software or the support and maintenance services (if any) by You, regardless whether the developers of MyITest4U have been advised or should have had knowledge of the possibility of such damages.
Governing Law
This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of Switzerland. All communications and any dispute associated with these Terms shall be in the German language.
